General Terms and Conditions

(pursuant to Chapter I, Title 3, Part 3 of Legislative Decree 206/2005 and subsequent amendments and additions)

1. Preamble and Effectiveness of the General Terms and Conditions

These general terms and conditions of sale (hereinafter, the “General Terms and Conditions”) govern the purchase of products and services, carried out remotely and made available through the internet on the ohoskin.com website (hereinafter, the “Website”) in compliance with Italian law, as set out in Legislative Decree 206/2005 and subsequent amendments (hereinafter, the “Consumer Code”).

(hereinafter “OHOSKIN®”)

Consumers accessing the Website to make purchases (hereinafter, the “Customer”) are required, before submitting an order, to carefully read these General Terms and Conditions, which are made available on the Website.

If the individual making purchases on the Website requests the issuance of an invoice and/or is not a “consumer or user” as defined in Article 3, paragraph 1, letter a), of the Consumer Code, the withdrawal provisions referred to in Article 7 of these General Terms and Conditions will not apply, nor, more generally, the provisions that under the Consumer Code are applicable only to “consumers”.

Contracts concluded with OHOSKIN® through the Website are governed by these General Terms and Conditions in compliance with Italian law. The language available for concluding the contract is Italian.

2. Selecting and Ordering Products

The characteristics and price of the various products for sale on the Website (hereinafter, “Product” or “Products”) are shown on the page relating to each Product.

To purchase Products, the Customer must select the desired quantity and follow the instructions on the Website. The Customer must add the Product to the “Cart”, enter shipping and billing details, select the desired payment method, and confirm the order.

By submitting an order through the Website, which constitutes a contractual offer, the Customer acknowledges and declares to have read all the information provided during the purchase process and to accept in full these General Terms and Conditions and the payment conditions described herein.

At the time of purchase, the Customer agrees to register on the ohoskin.com website and provide the requested registration data.

The contract between OHOSKIN® and the Customer is considered concluded upon acceptance of the order by OHOSKIN®. Such acceptance will be communicated to the Customer via an order confirmation email, containing the order number, shipping and billing details, the list of ordered Products with their main characteristics, and the total price, including shipping costs. The Customer must check the confirmation email and, if any errors are found, has 12 hours from receipt of the email to contact Customer Service at info@ohoskin.com.

After this deadline, the order will be processed for shipment and no further changes will be accepted, without prejudice to the Customer’s rights as described in Article 7 below.

Once the order is received, OHOSKIN® will verify the availability of stock for order fulfillment. If one or more Products are not available, OHOSKIN® Customer Service will promptly notify the Customer by email, who then has 12 hours to reply, confirming shipment of available Products or cancelling the order. In the absence of a response within this timeframe, the order will be considered confirmed.

3. Product Information

Information and characteristics regarding the Products are available on the Website, along with relevant Product codes.

The visual representation of the Products on the Website, where available, usually corresponds to the photographic image accompanying the descriptive sheet. It is understood that the image of the Products is for presentation purposes only and may not perfectly represent their characteristics and quality, and may differ in color and size. In case of discrepancies between the image and the written product description, the latter always prevails.

4. Prices and Shipping

Product prices include all taxes and duties. All prices are in Euros.

Shipping within Italy:
Shipping is free throughout Italy varies depending on the destination.

International Shipping:
The shipping cost for orders destined outside of Italy varies depending on the destination country.

Orders will always be fulfilled in compliance with the import restrictions of the destination country regarding certain product categories.

In such cases, OHOSKIN® reserves the right to process the order with the permitted Products, simultaneously cancelling and refunding the amount related to any prohibited Products using the Customer’s selected payment method.

Please note that the delivery times indicated on the website are for guidance only and are calculated from the date of shipment. OHOSKIN® is not responsible for customs clearance delays but will make every effort to minimize any inconvenience.

4.1 Order Tracking

After placing an order, the Customer will receive an email containing all purchase details. For further information, the Customer can contact OHOSKIN® Customer Service using the email address published on the site. Shipping is carried out within 48 business days from the order date, depending on the selected products. As soon as the package is handed over to the courier, online tracking begins, and the estimated delivery date is provided. The Customer can follow the progress of the delivery via the tracking link in the order confirmation email.

5. Payment Methods and Invoicing

Payment Methods
The Customer can pay for the Products and related delivery costs via PayPal.

The Website does not store the Customer’s credit card number. The relevant financial institution uses SSL protocol to encrypt data transmitted between its server and the Customer’s browser.

PayPal
Once the order is confirmed, the Customer will be redirected to the PayPal website, where payment can be made using their account or a card, including prepaid cards, or according to the methods accepted by PayPal, subject to the relevant terms and conditions.

Invoicing of Orders
If the purchase is made by a professional, it is possible to request an invoice by emailing info@ohoskin.com, indicating “invoice request” in the subject and including the billing information, tax code and/or VAT number, certified email (PEC), and electronic invoicing code in the email body. In this case, the invoice will be sent by email to the address provided. The professional is responsible for entering billing information correctly and is expressly informed that, if the invoice is not requested before the order, it cannot be requested later.

6. Shipping and Delivery

Products purchased on the Website will be delivered to the address provided by the Customer during the purchase process in the “Shipping Address” field.

All purchases will be delivered by IO SPEDISCO www.iospedisco.it (hereinafter, “Courier”) from Monday to Friday, excluding public holidays. OHOSKIN® is not responsible for unforeseeable delays or those not attributable to it.

Once the Products have been shipped, the Customer will receive a confirmation email including a link for tracking the shipment.

In any case, except in cases of force majeure or unforeseen circumstances, the ordered Products will be delivered within 15 (fifteen) business days from the day after OHOSKIN® confirmed the order to the Customer via the order confirmation email.

International shipments may be made with different couriers depending on the destination country to ensure the Customer gets the best available rate. For special requests, please contact info@ohoskin.com.

Shipments are made worldwide, except where customs restrictions apply to certain products.

7. Right of Withdrawal

The Customer has the right to withdraw from the purchase contract without the need to provide reasons and without any penalty, except in cases of exclusion provided in paragraph IV below. To exercise this right, the Customer must send a communication to OHOSKIN® within 14 days from the date of receipt of the Products, by email to info@ohoskin.com, specifying the date and order number found in the confirmation email. If the withdrawal is exercised before the Products are received, the communication may be sent at any time before receipt.

Once the communication is received, OHOSKIN® Customer Service will open a return procedure and inform the Customer about how to return the Products. The shipment and related costs are the responsibility of the Customer.

The right of withdrawal is subject to the following conditions:

  • The right applies to the Product in its entirety; if the Product consists of multiple components or parts, withdrawal is not possible for only part of the Product.
  • In the event of withdrawal, OHOSKIN® will refund the entire amount of the returned goods to the Customer, excluding shipping costs where applicable, within 14 days from the date the withdrawal notice is received, without prejudice to OHOSKIN®’s right to withhold the refund until actual receipt of the goods. The refund will be made using the same payment method used by the Customer, unless the Customer has expressly requested a different method. For wire transfers, the Customer must provide the bank details for the refund (account holder, bank name and address, and IBAN).
  • To ensure free returns under Article 8 below, Products must be returned in the same box in which they were received.
  • For hygiene and customer protection reasons, the right of withdrawal is only applicable to Products purchased on the Website that can be returned to OHOSKIN® and resold without health risks to consumers.

8. Warranty and Lack of Conformity

In case of lack of conformity of Products sold by OHOSKIN®, the Customer must immediately contact Customer Service by email at info@ohoskin.com.

The legal guarantees provided by Articles 129, 130, and 132 of the Consumer Code apply to the sale of Products. The Customer has the right, at their choice and if the type of Product allows, to have the conformity of the Product restored free of charge by repair or replacement, or to an appropriate price reduction, or to terminate the contract. These rights are forfeited if the Customer does not notify OHOSKIN® of the lack of conformity within 14 days from the date it was discovered, unless the Product is perishable or subject to expiry in a shorter period, in which case the defect must be reported within that shorter period.

9. Errors and Liability Limitations

Product information provided through the Website is regularly updated. However, it is not possible to guarantee the complete absence of errors, for which OHOSKIN® cannot be held liable, except in cases of willful misconduct or gross negligence.

OHOSKIN® reserves the right to correct errors, inaccuracies, or omissions even after an order has been submitted, or to modify or update information at any time without prior notice, without prejudice to the Customer’s rights under these General Terms and Conditions and the Consumer Code.

Except in cases of willful misconduct or gross negligence, any right of the Customer to compensation for damages or recognition of indemnity is excluded, as is any contractual or non-contractual liability for direct or indirect damage to people and/or things caused by the non-acceptance or fulfillment, even partial, of an order.

OHOSKIN® promotes the responsible consumption of alcoholic beverages and excludes all liability, except in cases of willful misconduct or gross negligence, for purchases made by minors under 16 years of age. By purchasing any alcoholic product, you declare that you are of legal age as per Article 7 of Law Decree 158/2012. OHOSKIN® assumes no responsibility in the event of purchases made by minors under 18 years of age who have declared otherwise.

10. Complaints

Any complaint must be sent to OHOSKIN® via email at info@ohoskin.com, Monday to Friday, or by certified email (PEC) to:

OHOSKIN® undertakes to respond to all requests received within 7 business days.

11. Online Dispute Resolution (ODR)

12. Applicable Law and Jurisdiction

The sales contract between the Customer and OHOSKIN® is concluded in Italy and governed by Italian Law. For disputes relating to the interpretation, execution, or termination of these General Terms and Conditions or individual purchase orders, if the Customer is a consumer as defined by the Consumer Code, jurisdiction is exclusively with the court of their place of residence or domicile, if located in Italy; in all other cases, jurisdiction lies exclusively with the Court of Catania, to the exclusion of any other competent court.

Pursuant to Article 1341 of the Italian Civil Code, by registering or placing an order on the Website, the Customer declares to have read and specifically accepts all the articles of these General Terms and Conditions.
